Please remember that you are you are being entrusted with a home that is owned, loved, and cared for by another person. As such, the following agreement is intended to create an understanding between you and the homeowner which sets and clarifies expectations, minimizes risks, and creates a foundation of trust for all involved.
By completing a reservation and paying balance, you hereby agree that you have read, acknowledge and agree to the terms and conditions contained within this agreement and that these terms and conditions are binding as a contract. In addition, the terms and conditions of this agreement are subject to change without notice. The updated and current version of this agreement is posted on our website, www.foxfellshastalake.com, and viewable by guest at all times. If you have any questions, please don’t hesitate to reach out.
Foxfell At Shasta Lake Short Term Rental Agreement
This Vacation Rental Agreement is made by and between the Homeowner of the property being rented in Shasta Lake, California, USA, and the individual completing the reservation, hereby referred to as “Guest,” as of the date last set forth on the completed booking form. “Guest” in this document, also includes and refers to all members of the party accompanying the individual who completes the reservation, and said individual agrees to take responsibility for their entire party as it pertains to policies within the following agreement. The parties hereby agree as follows:
1.IDENTITY VERIFICATION AND HANDLING OF PERSONAL INFORMATION
The Guest agrees that the information they provide on their reservation, including identity and contact information, is accurate and correct.
The Guest also acknowledges and agrees with the following statements provided by the Homeowner, regarding the identity verification process and handling of Guest’s personal information:
It is important for us and our insurance provider to know that the person renting and staying on the property is who they say they are. As such, the individual making the reservation must be present during the stay. We do not allow anyone who will not be part of the reservation themself to place a reservation for someone else.
As part of our booking process, you will receive an email requesting a photocopy of a government issued photo ID soon after placing your reservation.
Identify verification is a requirement of our insurance policy and helps us ensure a smooth and secure experience.
To facilitate a seamless check-in, please ensure the name on your ID matches the name used to create the reservation.
Personal information collected, including your ID, will be used for identity and background verification only, and will not be kept, sold, nor used for any other purposes ever. We use Safely.com to conduct identity/background verification. All ID photocopies will be permanently deleted by the Homeowner once identity verification is completed.
A failure to submit validation of your identity prior to check-in OR any reservation made under a false identity will be considered a Guest-initiated cancellation, and as such any potential refund will be subject to the cancellation policy as listed on your reservation. (All reservations cancelled by the Guest within 24 hours of booking will receive a 100% refund, regardless of refund policy, [this does not apply to bookings made within 72 hours of check-in.] Reservations cancelled by the Homeowner, for any reason other than Guest’s use of a false identity or failure to provide identity verification and/or payment in full, will also receive a 100% refund.)
Additionally, contact information, including phone number and email address, are collected in order for the house manager to contact you before and during your stay with any updates, information, responses, questions, or requests pertaining to your stay, and in some cases may also be used by us after your stay for follow-up communications, including: thank you notes, notifications of property left behind, and information about future availability and potential return stays. Once your stay is concluded, you may request to stop receiving communications at any time. Your contact information will never be shared nor sold to a third party ever. A failure to provide accurate contact information or failure to respond in a reasonable timely manner to house manager’s requests or queries regarding your stay at the property may also be grounds for cancellation of your reservation.
2.HOUSE RULES
Guest agrees that they and all in their party will abide by the following house rules:
PETS
• Up to 3 well-behaved cats and dogs are welcome (for other types of pets, contact host before bringing to property.)
• Each pet must be listed on your booking in advance of arrival, (Pet fees apply.) Registered Service Animals and ESA with a doctor's letter may stay free, per CA state law.
• Requirements for all pets: Non-destructive, house-trained, older than 6 months, up-to-date on flea medication.
• All pets must be kept off the furniture and beds, and may not be left in the house un-crated and unattended for more than 2 hours at a time.
• Guests are fully responsible for any and all damage caused by the presence of pets.
FIRES & SMOKING POLICIES
• Smoking and vaping allowed within the designated outdoor smoking area only (found on the rear deck.)
• All butts must be deposited within the provided disposal container.
• No fires, candles, nor fireworks (including sparklers) allowed anywhere on the property.
• The indoor wood-burning stove and provided propane BBQ are exceptions to the rule, and available for your use. If using either, please be knowledgeable and experienced with their proper use.
• Always turn propane tank and burners off when finished BBQ-ing.
• Burn only firewood (provided) in the wood stove, and always be sure the flue is open and the stove door closed.
• Please do not bring your own fire pits nor charcoal/wood grills. They cannot be used on the property.
PARTIES AND VISITORS
• No parties nor large gatherings allowed
• All humans and pets who will arrive at the property must be included on your reservation. No additional visitors permitted, (even if they don't plan to stay the night.)
QUIET HOURS
In accordance with local regulations, outdoor amplified sound is prohibited during the following hours;
M-F: 10:00 p.m. - 7:00 a.m.
S-S (and holidays): 10:00 p.m. - 9:00 a.m.
FOOD OUTSIDE/ BEAR SAFETY
For your own safety and the safety of future guests, do not leave any food outside the house. When throwing out food or food containers in the outside trash bin, please use a bin with functioning lid clasps and be sure to use the clasps to keep out scavengers.
TOWELS
The towels provided are for use inside the house only, and may not be taken outside. Please bring your own towels to use at the lake. Thank you.
KEEP DOORS CLOSED / BATS & INSECTS
Please keep exterior-facing doors closed whenever not actually in use in order to prevent flying insects and bats from entering the house and becoming trapped indoors with you, (yes, bats have entered and become trapped on multiple occasions when this rule was ignored.) If you are wanting to let a cool breeze in, simply open windows that have screens on them.
CLEANING
Guest agrees to practice common sense cleanliness and not leave an unreasonable mess. Do not leave any food out that may attract unwanted pests. Trash should be inside the indoor trash bins before you leave, not lying around the house. If there is a spill or accident and cleaning supplies are needed, you can find sponges and cleaners in a clearly marked cabinet in the downstairs hallway. If needed, you will also find a broom, mop, and vacuum cleaner in the upstairs closet/laundry room.
3.ACKNOWLEDGEMENTS
The Guest acknowledges that they have read and agree to the following information provided by the Host prior to booking:
SECURITY CAMERAS
For the safety and security of our property and its guests, we do have several outdoor security cameras in place to watch the driveway and building entry points.
STEPS/ACCESSIBILITY
Please note that the house is not easily accessible for wheelchairs. Both entrances do require using a couple steps. Likewise, the living room and downstairs bathtub also have step-downs.
OUTDOOR SAFETY AND CHILD SUPERVISION
Please note that the property is in a rural environment, and there is no fence separating our property from the surrounding woods. Potentially dangerous wildlife may be present near the home or on the grounds. The grounds should not be considered "child-proofed," and children's outside play should be supervised, and potentially hazardous areas or objects avoided. Neither the Homeowner nor any of his hosting team are responsible for injuries sustained from outdoor terrain, wildlife, or use of areas that are marked as off-limits for guests.
4.ACCESS
Guests will have exclusive use of the land and the main house, (with the exception of certain locked cupboards and closets.) The following support structures, however, are off limits for guests: garage, smaller cabin (unoccupied,) well and storage sheds, pool and hot tub area. These areas are clearly marked with signs, and will not limit your access to the house and amenities described in our listing in any way. (Please note that pool and hot tub behind the house have not been offered in this listing as amenities. They are currently non-operational and therefore fenced off for your group's safety and not included in the rental price.)
Guest shall allow Homeowner access to the property for purposes of repair, inspection, or emergency. Homeowner shall exercise this right of access in a reasonable manner by giving at least 24 hours notice (unless in case of emergency.)
5.CONDUCT
The Guest(s) shall behave in a civilized manner and shall be good neighbors, respecting the rights of surrounding property owners and tenants. The Guest shall not create noise or disturbances likely to disturb or annoy the surrounding neighbors. Quiet hours, as outlined in the included House Rules (section 1) and required by local governing authorities, shall be observed by all Guest(s.) Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Guest shall then immediately vacate the premises.
6.HOMEOWNER’S LIABILITY AND INSURANCE
The Guest and Guest’s party shall hereby indemnify and hold harmless the Homeowner against any and all claims of personal injury or property damage or loss arising from use of the premises. Guest expressly recognizes that any insurance for property damage or loss which the Homeowner may maintain on the property does not cover the personal property of Guest(s) and that Guest should purchase their own insurance, such as travel insurance, if such coverage is desired. If an in-stay cleaning is scheduled, valuables should not be left at the property during this time, and the Homeowner shall not be responsible if items that are left on the property become missing.
7.UTILITIES
The Homeowner shall be responsible for providing the following utilities: electricity, internet, oil/gas, trash collection, and water. The Homeowner is not responsible for temporary loss of services due to: provider-scheduled maintenance, unscheduled power outages not related to non-payment of bills, damage caused by guests, emergency situations, weather interference, or other acts of God/nature.
8.USE OF PROPERTY
The Guest expressly acknowledges and agrees that this Agreement is for transient occupancy of the Property, and that the Guest does not intend to make the property a residence or household.
9.SUBLETTING
The Guest shall not be allowed to sublet the property in part nor in full.
10.ILLEGAL USE
The Guest shall use the property for legal purposes only, and other use, such as but not limited to: illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this Agreement with no refund of rent or deposits.
11.TERMINATION
Should the Guest violate any of the terms of this agreement, the Homeowner has the right to terminate the rental period immediately in accordance with State law. Guest(s) wave all rights to process if they fail to vacate the premises upon termination of the rental period. Guest(s) shall vacate the premises at the expiration time and date of this agreement, ie: the checkout date and time included in their original booking.
12.SHORTENED STAYS AND WEATHER CONDITIONS
There shall be no refunds of rents due to shortened stays or ruined expectations because of weather or traffic conditions or other conditions outside of the Homeowner’s control.
13.FIRE ALARMS
The Guest must notify the Homeowner without delay if a fire alarm “chirps” or has a low battery condition.
14.POSSESSIONS
Valuable items left behind by the Guest will be held with every reasonable effort made to contact in order for a safe return. If items are not claimed for longer than six months they shall become the property of the Homeowner. Homeowner shall not be held liable for the condition of said items by the Guest. Guest will be responsible for covering any shipping and/or delivery costs associated with the safe return of said items.
8.ATTORNEY’S FEES
The Guest agree to pay all reasonable costs, attorney’s fees and expenses that shall be made or incurred by the Homeowner enforcing this agreement should it become necessary to do so.
16.GOVERNING LAW
This Agreement is governed under the laws in the state where the property is located.
17.SEVERABILITY
In the event that any provision or part of this Agreement is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Agreement, will be inoperative.
